Finance options for your family law matter
Good advice should not depend on how much cash you have today. If your property settlement will leave you with funds but money is tight now, you may be able to pay your legal fees at the end.

Many separating families are asset rich and cash poor. The house, the super and the business are all there, but none of it is available until the settlement is finalised.
That gap can push people to settle too early, or for less than they should, simply to stop the legal costs. Funding supports your cash flow while the matter runs, so decisions are made on the merits rather than on what you can afford this month.
Many of our clients use JustFund, a specialist family law funder, to cover their legal fees while the matter runs. We also work with other funders and lenders, and we are happy to facilitate a conversation so you can compare your options. The funder makes its own assessment and sets its own terms.

Your options
Every family’s finances are different. We help you understand the options and choose what fits.
Pay at the end with JustFund

Florens Family Law does not provide credit. Funding is provided by independent funders on their own terms, and fees and interest apply. Consider getting independent financial advice before you sign any funding agreement.

The process is straightforward, and you will know the costs before you commit.

In your free 20-minute discovery call, let us know if cash flow is a concern. It will not change the quality of the advice you receive.
Explore your options
We explain how funding works and which options may suit you, including JustFund and other funders or lenders.
Speak with the funder
We facilitate an introduction. The funder assesses your eligibility, usually by looking at the likely property pool and settlement.
Review the terms
The funder sets out its fees, interest and repayment terms in writing. Take the time to read them, and get independent advice if you need it.
Your matter proceeds
Your legal fees are paid by the funder as the work is done, so you can focus on the right outcome rather than the next invoice.
Repay from your settlement
When your settlement is finalised, the funding and any agreed costs are repaid, usually from the settlement proceeds.
Is funding right for you?
Funding is a useful tool, but it is not for everyone. Three things to weigh up.
Usually property matters
Funding is most often available where there is a property settlement to repay it from, such as equity in a home, savings or superannuation.
Funding has a cost
Funders charge fees and interest. We will help you understand how those costs compare with paying as you go.
You stay in control
Using a funder does not change who makes the decisions in your matter. That is always you, with our advice.
Court fees
If your matter involves a court application, the Federal Circuit and Family Court of Australia charges filing fees. These are separate from our legal fees.
Reduced fees may be available if you hold certain concession cards or are experiencing financial hardship. We will tell you which fees apply before anything is filed.
Court fees from 1 July 2026
- Application for divorce$1,170
- Divorce, reduced fee for eligible applicants$390
- Application for consent orders$215
- Initiating application, parenting or financial (final orders)$455
- Initiating application, parenting and financial (final orders)$740
- Interim orders, in addition$155
Court fees are set by the Australian Government, not by us, and usually change each July. They are separate from our legal fees.
Common questions about finance options
Who is eligible for funding?
Eligibility is decided by the funder, not by us. Funders usually look at the likely property pool and settlement, and whether there will be enough to repay the funding at the end.
What is JustFund?
JustFund is a specialist funder that pays legal fees during a family law matter, with repayment usually made from the settlement. Many of our clients use it. Terms, fees and eligibility are set by JustFund.
Do I have to use JustFund?
No. We also work with other funders and lenders, and some clients prefer to pay as they go. We are happy to facilitate a conversation so you can compare options.
Does funding cost more than paying as I go?
Usually, yes. Funders charge fees and interest for the time your fees are outstanding. For many clients the benefit of protecting cash flow, and not settling too early, outweighs that cost, but it is a decision to make carefully.
Can funding be used for parenting matters?
Funding is most commonly available for property matters, because repayment comes from the settlement. Where a matter involves both parenting and property, some funders may consider it. We can talk through your circumstances.
Will using a funder affect my advice?
No. Our advice is the same however your fees are paid. The funder has no say in the decisions you make or the outcome you agree to.
What if my settlement is less than expected?
This depends on the funder’s terms, so read them carefully before you sign. We can explain how different outcomes might affect repayment.
This is general information, not legal advice for your situation.
Cost should not decide your outcome.
